AroundTown, established in Rotterdam, registered with the Chamber of Commerce under number: 74789201, registered terms and conditions there.

 

  1. General

1.1 Participants: Participant is understood to mean any (legal) person who has made a reservation or booking with AroundTown and wishes to make it, and apart from his / her representative (s), authorized representative (s) and successor (s), as well as the person (s) ) for whom the booking has been negotiated. The person who signs an AroundTown confirmation on behalf of or for another person is liable for all obligations arising from the confirmation. In addition, all persons stated upon confirmation are each liable for their own part.

1.2 Activities: Activities include city walks, bus tours, boat trips, day packages, events and

understand workshops.

 

  1. Applicability

2.1 These conditions apply to all offers, quotations, proposals, confirmations and bookings.

2.2 The applicability of the customer’s general terms and conditions is expressly rejected by us.

2.3 These conditions can be deviated from in writing.

 

  1. Agreement

3.1 An agreement is concluded by signing the confirmation and returning it within 8 days.

3.2 The prices and reservations are valid until the option expiry date as stated in the offer. After the expiry date of the offer, there is no longer a guarantee on the prices indicated.

3.3 AroundTown is entitled to refuse a reservation or booking without giving reasons.

3.4 Transport costs are included in the quotation as a separate item and are not included as standard in the agreement.

 

  1. Payment

4.1 Within 7 days after the conclusion of the agreement, a deposit of 80% of the agreed price must be made per group.

4.2 AroundTown sends a total invoice of the entire booking upon confirmation. The total final amount must be paid no later than 7 days before the start of the booking.

4.3 In the event of late payment AroundTown is entitled to cancel the booked activity. Money already paid will not be refunded and the provisions in article 11 of these conditions will then apply.

4.4 The invoice is deemed to have been approved if the participant has not responded within 8 working days after the invoice date; the customer also undertakes to pay the invoice.

4.5 If residual payments are not made within the payment term stated on the invoice, AroundTown may charge 15% of the total price.

4.6 All communicated prices are in Euros and the VAT percentage is stated in the invoice.

 

  1. Implementation

5.1 AroundTown undertakes to execute the agreement to the best of its knowledge.

5.2 AroundTown undertakes to carry out the activities within the agreed time schedule, except in case of force majeure.

5.3 If a customer arrives later than agreed at the agreed time, the agreed end time will be adhered to.

5.4 If the end time is exceeded, extra costs will be charged.

 

  1. Liability

6.1 AroundTown accepts no liability for damage resulting from death, injury, accident, injury, loss or theft caused to the participant (s) during or as a result of the activity, unless there is intent and / or gross negligence of ( the employees of) AroundTown.

6.2 Participants are expected to use rented materials responsibly.

6.3 If after an activity it is established that damage has been caused to the rented materials, this falls under the liability of the tenant. Costs resulting from the repair fall under the tenant.

6.4 If rented materials are not returned, the new value will be charged.

 

  1. Changes in the activity program

7.1 AroundTown reserves the right to make changes to the program or to cancel the program, for reasons related to its own business operations or to third parties. AroundTown then undertakes to notify the customer immediately.

7.2 In the event of cancellation as referred to in the above article, AroundTown undertakes to immediately repay the payment that has already been made in full or in part. However, this only applies if AroundTown has not offered a replacement program equivalent to the group.

7.3 The agreement can be changed by the customer. Reducing the number of participants within a margin of 10% is only possible for individually booked restaurants, catering and scooter rental and not for tailor-made group packages. This reduction can be applied free of charge up to eight working days before departure before 4 p.m.

7.4 If the number of participants exceeds 10%, the cancellation provisions in Article 8 will be applied.

 

 

7.5 An increase in the number of participants must be reported in writing 8 working days in advance. Full price is always charged. AroundTown cannot guarantee that these additional reservations are always possible.

7.6 For all the above changes from 25 persons, the customer owes € 12.50 administration costs per group.

 

  1. Cancellation and modification

8.1 Cancellation of an arrangement must be made in writing. The date of the postmark is the cancellation date.

8.2 In case of cancellation, the following amounts will be charged, unless agreed otherwise.

  1. If cancelled up to one month before the day the activity takes place, an administration fee of € 12.50 will be charged.
  2. If cancelled up to 2 weeks before the day of the activity, 50% of the total price will be charged.
  3. If cancelled within 2 weeks before the day that the activity takes place, 75% of the package sum will be charged.
  4. If cancelled within 3 days before the day that the activity takes place, 100% of the package sum will be charged.
  5. Changes in the number of participants up to a difference of 10% can be made free of charge up to 3 working days before departure. If the changes are made within 3 working days, the cancellation costs are 100% of the package. If the change in the number of participants is greater than 10%, this can be passed on to AroundTown free of charge up to two weeks before the day of the AroundTown activity. Within those two weeks, the cancellation costs are 100% of the package sum.

 

  1. Complaints

Despite all concerns, it is of course always possible that the participants have a justified complaint. This complaint should be made to AroundTown immediately, if possible on the day itself. If direct filing is not possible, or if the complaint is not resolved satisfactorily, it must be submitted to AroundTown in writing and motivated no later than one week after.

 

  1. General reservation AroundTown accepts no responsibility for photos, brochures and other information material, insofar as published by third parties.

 

  1. Participation in the AroundTown program

During an AroundTown program, the organization has the right to exclude participants from (part of) the activities if, in its opinion, physical, moral or mental abnormalities or conditions reveal themselves to them in such a way that the activity is considered to be more difficult or prevented ( or threatens to become). The person concerned cannot claim an alternative program. The person concerned is not entitled to a refund of the participant sum. This provision also applies to misconduct.

 

  1. Applicable law and disputes

12.1 In the event of a dispute about an agreement, both parties will endeavor to resolve this in consultation. If the dispute is not resolved, it will be submitted to the competent civil court in Rotterdam.

12.2 Dutch law applies to all reservations and bookings Rotterdam, jan 2019.
